Blog Affiliate Program ("affiliate program" or "program") Terms

• After joining the blog affiliate program, you must provide the following information before receiving a payment from gain6. If you cannot provide this information, do not join this program.
• Your verified email address. We will send a message to your email address after you join gain6; you must click the link in the message to verify you are receiving our email messages. We don't send spam (privacy) but we do need to be in contact with you in case of issues regarding your account.
• A secure login password. Your password must contain Letters, Numbers and Special Characters. It must be at least 4 characters long. You will probably be required to change your original password to a password that meets these requirements when you first log in.
• Answers to two (2) of six (6) possible security questions. You will be asked to repeat your answers to these questions when making sensitive account requests.
• A verified PayPal email address (if you want to be paid at PayPal): We will send an email message to your PayPal Email Address; you must click the link in the message to verify that you have email access to your PayPal email address.
• Your postal mailing address and phone number (if you want to be paid by Check, U.S. residents only):. This includes the street number & name, or PO Box, city, state, zip code, and a phone number which we can call to verify your mailing address. We must speak with you personally by phone prior to mailing your Check. This is an address verification call only, not a sales call.
• Abide by Income Tax Requirements (see more below). If your gain6 earnings meet or exceed $500 in a given tax year, you will be required to provide your IRS Form W-9 to gain6, Inc. This form contains your U.S. Taxpayer Identification Number and enables gain6, Inc. to file the required IRS Form 1099, which reports the amount of your gain6 earnings during the tax year to the IRS (Internal Revenue Service).
• Payment by Check. If you reside in the United States and have a U.S. postal mailing address and a working U.S. phone number, you may elect to have payment made to you by Check. Payment will be made by Check only if your payable balance is at least $100, and only if we are able to speak to you personally by phone to verify your mailing address (this is not a sales call - it's an address verification call. Gain6 never makes sales calls). It is your responsibility to keep your mailing address updated on your Profile. There is a 10% Check processing fee which will be deducted from the amount of your Check. Example: If your payable balance is $100, your Check will be for the amount of $90. We recommend you use PayPal to receive payments, which will reduce the minimum balance requirement and eliminates the Check processing fee. Checks that need to be cancelled and reissued will cost an additional $45, which will be deducted from the reissued Check amount. A Check will not be sent if the resulting check amount (after fees) is less than $90. Checks not redeemed within of 90 days will become void and the Check amount will be considered unpayable - the Check amount will be forfeited.
• Payments will be made at the end of each month to you if your prior month-end balance ("payable balance") met the minimum requirement as follows:
  • A payment will be made to your PayPal account if your payable balance is at least $6. PayPal will deduct their transaction fee from the payments you receive.
  • A payment will be made by Check if your payable balance is at least $100 (U.S. only). Gain6 charges a 10% Check processing fee which is deducted from the amount of your Check.
• If gain6 is unable to make payment to you for 2 consecutive months because your PayPal account is not working, or because your Check mailing address is not working, or a Check is not redeemed within 90 days, or we could not speak to you personally by phone to verify your address, or because you did not provide the IRS Form W-9 when required, or for any other reason, then you forfeit the unpaid program earnings. We may send notification to your profile email address, but we are not required to notify you.
• You cannot allow the program earnings to accumulate over time in your gain6 account - you will be paid every month that your prior month payable balance was met. There may be an option to reserve some extra money in your gain6 account, if you decide to participate in certain optional gain6 programs in which you can use your balance earnings to make "purchases".
• You cannot participate in the blog affiliate program if you are located in a country embargoed by the U.S., or are on the U.S. Treasury Department's list of Specially Designated Nationals. View which countries can participate.
• You cannot participate in the blog affiliate program if you are under 16 years old.

• gain6 cannot and does not provide tax advice. No statements in this document are meant to act as tax advice.
• It is your responsibility to pay any U.S. or State income taxes on your gain6 earnings, or the required taxes in other countries. It is your responsibility to know your applicable laws and pay the required amounts.
• When you have earned a total of $500 or more, you must send your completed IRS Form W-9 to gain6, Inc. prior to receiving any further payments from gain6. Use this IRS link: http://www.irs.gov/pub/irs-pdf/fw9.pdf to download, print and legibly complete IRS Form W-9 and fax it to: 1-866-469-3669. Or you can mail it to: gain6, Inc., 17011 Lincoln Ave. #610, Parker, CO 80134.
• For anyone earning $600 or more in a tax year, gain6 will file IRS Form 1099 which reports the amount of your gain6 earnings during the tax year. IRS Form W-9 provides gain6 with your U.S. Taxpayer Identification Number (social security number or EIN), which enables us to file your IRS Form 1099.
• Non-receipt of your IRS Form W-9 will cause gain6 to be unable to pay you any additional earnings over $500. If gain6 is unable to make payment to you for 2 consecutive months, then you forfeit all unpaid earnings and your gain6 account may be terminated. We may send notification to your profile email address, but we are not required to notify you if this happens. Log in regularly to check your account.

Definitions

• By "gain6.com" or gain6 we mean the features and services we make available, including through (a) our website at gain6.com and any other gain6 branded or co-branded websites (including sub-domains, international versions, and mobile versions); (b) our Platform; and (c) other media, devices or networks now existing or later developed.
• By "us," "we" and "our" and "gain6" we mean gain6, Inc., or gain6.com.
• By "content" we mean the content and information you post on gain6.com, including information about you and the actions you take.
• By "post" we mean post on gain6.com or otherwise make available to us.
• By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.

Program: Option to Buy Available Friends
The purpose of this program is for you to attempt to increase your blog affiliate program earnings. This section describes the overview and terms for this optional program.

Overview. Many people sign up for gain6.com without having been invited by a friend, so no one will earn the blog affiliate program commission for their signup. These are "Available Friends". If you mark the box on your program settings that says "Buy Available Friends whenever possible" then you will join this optional program. In this program, you will "stand in line" with other program members to buy the next available friend for the price of $6. This is paid from your current account balance, not from any additional money you would pay.

When an Available Friend signs up, and if you are currently first in line, this program will automatically subtract $6 from your current balance to buy the Available Friend for you. Then, you will receive the blog affiliate program commission from this person's signup (now) and also the commissions from 6-tiers of their friend signups (later as they occur) - just as if this person joined on your gain6 blog. After successfully buying a friend, you will go to the back of the line to await your turn again to buy another available friend.

Terms for Buying Available Friends - an optional program for enhancing the blog affiliate program ("the program")

• When you check the box to "Buy Available Friends whenever possible", this creates a standing order to the gain6 system. It is your responsibility to uncheck the box when you want the system to quit buying available friends for you. Available Friend purchases cannot be undone - all transactions are final.
• The system will buy a maximum of one (1) available friend for you per day.
• You must have at least $6 available in your account when your turn to buy an available friend arrives. You cannot buy available friends by paying out-of-pocket money.
• $6 is deducted from your program account balance when the system buys an available friend for you.
• Because we pay you the prior month-end balance of your earnings each month, it is possible your balance will be less than $6 when your turn to buy arrives. If this happens, you will "stand aside" at the front of the line until your balance grows again to at least $6. In the meantime, the next person in line can buy the available friend.
• We will attempt to notify you at your profile email address when this program purchases an available friend for you; we are not required to notify you. Log into gain6.com regularly to review your program account activity (transctions).
• Available friends who are "sold" are not notified.
• You can stop your standing order to "Buy available friends whenever possible" (to quit participating in this program) by going to the Blog Affiliate Program / Settings and unchecking the box called "Buy Available friends whenever possible".
• Available friend purchases cannot be refunded to your account balance, so be sure to uncheck the box before the program uses your balance money to buy another available friend.
